X Factor and Dancing With The Stars in toilet 'turf war' (as singing show wins in battle of the ratings)

The X Factor and Dancing With the Stars are not only battling in the ratings, but over a shared bathroom.

The office argument over cupboard space writ large was sparked after Simon Cowell's flashy production moved into the same premises as the steady ABC favourite for last night's live show.

Both shows are currently filming at the CBS Television City lot in LA, but last night marked the first time that their live shows went up against each other - and it caused a lavatorial disaster.

Problems arose with the Fox show tried to stake its claim to the toilets with a sign on the door which says with typical bombast and branding 'X Factor Restroom.'

Obviously, this didn't go down well with the crew on the ABC show, who have been working live on this night for years.

So someone referring to himself simply as 'Rob' posted a sign on the toilet door below the X Factor poster which reads: 'These restrooms are for everyone. If you have a problem with that, come see me. I’m on stage 46. Just ask for Rob. I’m the 6’ 3' black man. D.W.T.S.'

Caught short: Incumbent names at Dancing with the Stars seemed to be sidelined

There has been some suggestion that the architect of this show of territorial strength was Rob Kardahian, 24 ,  joking about his potential to intimidate toilet hoggers.

Other contestants on the show include Ricki Lake, David Arquette, J.R. Martinez and Chaz Bono.

According to TMZ, X Factor sources said their sign was to tell staff where the toilets were on the new show and 'not to stop anyone else using it.'

An  spokeswoman said: 'Please tell Rob he’s welcome to use our restrooms anytime!'

But while they may have acquiesced on that battle, it was the X Factor that won the ratings war last night.

Simon Cowell's show firmly marked the territory of Tuesday night live shows by scoring over 11 million viewers, half a million more than Dancing with the Stars.

It was the number one programme in it's slot, and grew in viewer numbers during it's two hours from 8pm to 10.30.

The show was also up on last week's outings
